1 Acceptance of Terms
By downloading, installing, or using the DareNite application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. We reserve the right to modify these Terms at any time, and your continued use of the App constitutes acceptance of any changes.
2 Eligibility
DareNite is intended for users aged 17 years and older. The App contains adult-oriented party game content including suggestive themes and mature humor. By using the App, you represent and warrant that you are at least 17 years of age. If you are under 17, you are prohibited from using this App.
3 Description of Service
DareNite is a social party and couples game application offering various game modes including Truth or Dare, Would You Rather, Never Have I Ever, Most Likely To, Spin The Bottle, Couple Challenge, Speed Round, and Date Night. The App provides both free and premium content accessible through subscription plans.
4 User Accounts & Data
- DareNite does not require account registration. Game data is stored locally on your device.
- You are responsible for maintaining the security of your device and any data stored within the App.
- Player names entered during gameplay are stored locally and are not transmitted to our servers.
- Custom card decks you create are your content and remain stored on your device.
5 Subscriptions & In-App Purchases
5.1 Subscription Plans
DareNite offers premium subscription options that may include Weekly, Monthly, Annual, or Lifetime plans. Pricing may vary by platform and region. The exact cost, billing frequency, and renewal terms are always displayed within the App prior to purchase.
5.2 Billing & Renewal
- All purchases are processed through Apple's App Store or the Google Play Store and are subject to their respective terms and conditions.
- Auto-renewable subscriptions will automatically renew unless cancelled at least 24 hours before the end of the current billing period.
- Your Apple ID or Google Play account will be charged for renewal within 24 hours prior to the end of the current period.
- You can manage and cancel subscriptions in your device's Settings > Apple ID > Subscriptions (for iOS) or Google Play Store > Payments & subscriptions (for Android).
5.3 Free Trial
If a free trial is offered, the unused portion of the trial will be forfeited when you purchase a subscription. Free trial eligibility is determined by Apple or Google and may be limited to one trial per account.
5.4 Refunds
All purchases are final and non-refundable, except as required by applicable law. Refund requests must be directed to Apple through their standard refund process at reportaproblem.apple.com or to Google through the Google Play Help Center.
6 Premium Features
A DareNite premium subscription unlocks:
- All game modes (Couple Challenge, Speed Round, Date Night, and more)
- All heat levels (Dirty, Extreme, After Dark, Rising)
- Access to new content updates and exclusive card packs
- Ad-free experience
Free users have access to Truth or Dare and Would You Rather game modes with Clean and Spicy heat levels.
7 Acceptable Use
You agree to use DareNite responsibly and in accordance with these guidelines:
- Play only with consenting adults who understand the nature of the game content.
- Do not use the App to harass, bully, or pressure any participant.
- All participants should feel comfortable declining any dare or challenge at any time.
- Do not create custom cards containing illegal content, hate speech, threats, or content that promotes harm.
- Do not reverse-engineer, decompile, or attempt to extract the source code of the App.
- Do not use the App for any unlawful purpose.
8 Intellectual Property
- The DareNite name, logo, design, content, card text, and all associated intellectual property are owned by DareNite and protected by copyright and trademark laws.
- You may not reproduce, distribute, modify, or create derivative works from any App content without prior written consent.
- Custom content you create within the App remains your intellectual property, but you grant us a non-exclusive license to store it locally on your device for App functionality.
9 Disclaimer of Warranties
DareNite is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. We do not warrant that:
- The App will be uninterrupted, error-free, or secure.
- Any defects will be corrected in a timely manner.
- The App will meet your specific requirements or expectations.
- The content is appropriate for all social situations or group dynamics.
10 Limitation of Liability
To the maximum extent permitted by applicable law, DareNite and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, including but not limited to:
- Any actions taken by players during or as a result of gameplay.
- Loss of data stored locally on your device.
- Interpersonal conflicts arising from game content or dares.
- Unauthorized access to your device or data.
Our total liability shall not exceed the amount you paid for the App or subscription in the 12 months preceding the claim.
11 Content Responsibility
DareNite provides pre-written game content designed for adult entertainment. Players participate voluntarily and are responsible for their own actions. No dare, truth, or challenge within the App should be interpreted as an obligation. Any participant may skip or refuse any prompt at any time without consequence.
12 Termination
We reserve the right to terminate or suspend access to the App at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App ceases immediately.
13 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which DareNite operates, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.
14 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
